In the lawsuit, filed Tuesday in Los Angeles Superior Court, Constantin alleges that Goodman agreed to receive $500,000 to appear in the pic, an adaptation of Donna Woolfolk Cross' 1997 novel to star German thesp Franka Potente. Based on a medieval legend, story chronicles the life of a woman who, disguised as a man, ascends the papal throne.
Goodman had reportedly agreed to play Pope Serguis in the pic, scheduled to start shooting in May. Constantin said in the lawsuit that it had relied on a verbal agreement with Goodman and therefore did not cast any other actors for the part.
Company is seeking damages for "significant sums" lost on pre-production activities.
Goodman's reps notified Constantin in March that the actor would not be appearing in the film, according to the suit.
In a statement to Web site TMZ, Goodman's publicist, Stan Rosenfield, said: "There were talks about Mr. Goodman participating in the 'Pope Joan' project, although no agreement was ever reached. This is a frivolous lawsuit."
Constantin confirmed the lawsuit but would not comment on it.
