The org rejected CBS' argument that Janet Jackson's breast-baring performance in the 2004 Super Bowl didn't break any decency rules. Following the incident, the FCC fined the Eye $550,000.
Part of the network's argument was that it was unaware that the incident was going to take place -- and that when it did, the entire controversy took less than a second.
The Super Bowl returns to CBS in February, with Prince scheduled to perform at halftime.
