'Alpha' judge to see movie before ruling

Defense asks film to be denied release

A judge wants to see Universal's "Alpha Dog" before deciding whether to block its release.

The defense attorney for Jesse James Hollywood, who has asked that the film not open until the court case is over, says "Alpha Dog" will taint the jury pool. Hollywood, who has plead not guilty to the kidnap and murder of 15-year-old Nicholas Markowitz could face the death penalty if convicted.

Pic, based on the Hollywood case with the names changed, is scheduled to open Jan. 12.
