Winkler seg aired post cutoff date; Macy replaces

Maybe the Fonz needs to hear about this one: The Academy of Television Arts & Sciences on Friday pulled Henry Winkler's Emmy nomination for outstanding comedy guest actor after ruling that his stint on "Battery Park" was ineligible.

Winkler's nom was thrown out after Academy officials discovered that his episode didn't air until after May 31-- the cutoff date for the Emmy eligibility period.

In his place, William H. Macy has picked up a nom in the category for his multi-episodic stint as a consultant on ABC's "Sports Night."

An Academy spokeswoman said the official entry for Winkler's guest shot on "Battery Park" listed an April airdate. But as it turns out, NBC yanked the low-rated DreamWorks skein a week before the Winkler seg was set to air.

Instead, the "Battery Park" episode was finally telecast in June. DreamWorks officials said exec producer Gary David Goldberg's UBU Prods. sent out the nomination in April, before the show was set to air, and contacted the Academy to make the correction after NBC pulled the show. Academy officials, however, said the call came later.

Winkler could still pick up a statuette in September: He's also nominated in the drama guest actor category for his role on ABC's "The Practice."

"The Lord giveth and the Lord taketh away," Winkler said. "I am thrilled to be nominated for 'The Practice' and 'Battery Park,' even though it did not qualify."

Macy, meanwhile, will now be competing with Bruce Willis, Tom Selleck, Carl Reiner and Anthony LaPaglia for kudos in the guest actor in a comedy series category.Meanwhile, the Academy also announced a change in one of the telefilm categories. A line producer for the mini "Aftershock: Earthquake in New York" accidentally put NBC on the official entry ballot. The pic actually aired on CBS.

And the commercial "Let's Light This Candle," for Ameritrade Online/Financial, has been nominated in the outstanding commercial category. Ad, produced by Epoch Films and handled by ad agency OgilvyOne Worldwide, replaces "When I Grow Up."

As a result of the changes, NBC drops from 97 noms to 95 -- but the Peacock is still far and away this year's nominations leader. ABC bumps up from 64 to 65 noms, while CBS picks up one more to reach 42.
