Cablers lose bid to block must-carry

The cable industry's bid to block implementation of must-carry rules until the U.S. Supreme Court decides on their constitutionality was denied in U.S. District Court Thursday.

The three-judge panel voted 2-1 against granting the cable industry an injunction seeking relief from immediate implementation of must-carry.

The same court last week delivered a devastating blow to cablers by ruling that broadcasters have a constitutional right to be carried by cable operators.

Cable lawyers are expected to ask the U.S. Supreme Court to delay implementation of the rules until the high court hears the merits of the case. A delay is unlikely to be granted, according to industry lawyers.

Under a timetable set by the Federal Communications Commission, must-carry regs will take effect June 2.
